Problems with Ukrainian order

مشاركة بواسطة hayder » السبت يناير 08, 2011 11:38 pm

The military display for the 90th anniversary of the establishment of the iraqi armed forces was an interesting revelation more for what was not displayed than for what appeared.

The absence of the BTR-4 and An-32b brought to the fore the problems that iraq is experiencing with the $2.5bn contract for arms purchases with Ukraine. The first segment of this contract was a $550M contract for 420 missile armed BTR-4s as well as 6 new build An-32b transport aircraft with 4 options.

Morozov, the prime contractor for the BTR-4 has faced problems with engine deliveries and has failed to keep to its stipulated delivery deadlines (for which Iraq paid a premium). Iraqi crews sent to Ukraine were trained on the prototype BTR-4s and found on their return to Iraq that no production vehicles have been delivered for them to crew!

Likewise, Antonov had completed one airframe for iraq by august 2010, but upon inspection by the Iraqi airforce inspectorate bureau sent to Ukraine, it was found to contain second hand engines and avionics (in contravention of the contractual agreement which stipulated new engines and glass cockpit). Iraq refused to take delivery and now the procurement officers in charge of the contract are under investigation by the Iraqi MoD inspectors general as well as the national "hey'et al nazaha" (the anti-corruption directorate).

This news brings back a feeling of dejavu for long time observers of Iraq's military development and the similarities to the ill fated deal with bumar of Poland in 2004 come to mind.

So who is the main beneficiary of this particular fiasco?

It's not Russia, since whilst Russia is delivering their latest Mi-17s to Iraq, shipments have been delayed and prices raised to the $11-$13M mark (which makes it no longer price competitive vs its western counterparts, but with much worse service and support).

It's not the US either, since whilst the US military contractors are doing their best to provide quality service and support, the US congress has been delaying and blocking Iraqi requests for the equipment they really need (notably super hornets, apaches and AMRAAMs), leaving Iraqis reluctant to engage in the FMS game of cat and mouse requests for even the simplest things at the whims of the US congress (and largely for internal political consumption as opposed to the ideal of nurturing the long term development of a nascent US ally in a critical region).

The winners can thus be named: France, Italy, China and Serbia. Each of these has done very well in delivering equipment to Iraq on time, with good backup support and no attempts at "cheating" by including substandard equipment, second hand parts, delayed shipments and price increases mid-way through contracts. They also do not come with the baggage of political acceptance, public/political howling about "arming the enemy" and long winded FMS process that seems to accompany the simplest of requests from the US.

What will this mean for the future?

Iraq to receive Ukrainian armored personnel carriers in February
Kyiv Post ^ | 17 January 2011 | Interfax-Ukraine
Posted on Mon Jan 17 2011 18:19:03 GMT+0000 (GMT) by DJ Elliott

The first shipment of BTR-4 armored personnel carriers built in Kharkiv under a contract signed in 2009 to supply over $550 million worth of Ukrainian armaments and hardware to Iraq will be delivered to the client in February, an informed source told Interfax.

"The delivery of 26 armored personnel carriers is planned for late February," he said.

The delivery was planned for late 2010 at first, but Ukraine and Iraq suspended the supplies for full testing of the armored personnel carriers to tactical and technical characteristics.

"The time of the second delivery will be specified when the client accepts the first shipment," the source said.

The Progress foreign trade company, a subsidiary of Ukrspecexport, signed the over $550 million contract with Iraq in 2009. The contract was expected to start a series of military-technical cooperation agreements.

According to the contract, Ukraine will supply over 400 pieces of armor, including BTR-4, and six Antonov An-32 aircraft and will repair aircraft within 3-3.5 years.

The Ukrainian media said several days ago that the Iraqi Defense Ministry refused to accept the armored personnel carriers produced in Kharkiv and the largest defense order in Ukraine was endangered. The administration of the Kharkiv Morozov Machine Building Design Bureau put the blame on gun producers from Kamianets-Podilsky. The shortcomings were exposed when Iraqis were examining the armored personnel carriers.

Ukraine and Iraq have made adjustments to the schedule of deliveries of the first Ukrainian BTR-4, built at the facilities in Kharkiv in the framework of the concluded in 2009 a contract for the supply of Ukrainian weapons to Iraq worth more than $ 550 million, said a source familiar with the details of the implementation of the contract.

"In consultation with the Iraqi side outlined earlier in the December 2010 first shipment of armored vehicles will be conducted in the first quarter of 2011," - said the source.

"Its production ceased last year. Adjustments made by the parties are specifically as possible. The scope of supply will remain the same," - he said.

Delivery of the second installment of the BTR-4 in Iraq is scheduled in the second quarter of 2011, the source said.

According to previously voiced by Ukrainian officials data, it was expected that 11 new Ukrainian BTR-4 will take part in a parade to celebrate the Day of the Iraqi Army on January 6.

In 2009, a subsidiary of state-owned Ukrspetsexport - SOE Specialized Foreign Trade Firm Progress has signed a contract with Iraq worth more than $ 550 million, which is supposed to be one of the upcoming series of agreements in the sphere of military-technical cooperation between Ukraine and Iraq.

The contract provides for delivery within 3-3,5 years, more than 400 armored vehicles, in particular the BTR-4, 6 light transport aircraft An-32, as well as carrying out services related to repair of aircraft.

Among the major artists of the contract will make Kharkiv Design Office for Mechanical Engineering. Morozov (KMDB) and state-run plant them. Malysheva (Kharkiv), GP Antonov (Kiev).

According to GP Antonov, has now been completed assembly of the first two vehicles for the Iraqi customer, is the timing of their delivery.

The company had previously voiced plans to put under contract in Iraq until the end of 2010 the first three AN-32, the transfer of 3 more scheduled for 2011-2012.

According to earlier official statements voiced by Ukrainian authorities, the conclusion of the contract was the "logical extension" of Ukraine's participation in the peacekeeping mission in Iraq. The total volume of the impending deal, according to unofficial estimates, could reach $ 2.4 billion

Iraq has fined the Ukraine for the plane
January 19, 2011 12:14 | Tatiana Boychenko

Iraq has fined the Ukraine for the failure of delivery dates of the Party of An-32B.

Iraq has exposed the Ukraine penalty of $ 165 thousand for the failure of delivery dates of the Party of An-32B.

About this newspaper on Jan. 19 " Focus , "citing its sources close to the arms business.

The total amount of fines, as the newspaper notes, could grow to $ 55 million This authorization is provided by the contract.

In late 2009, the Iraqi Defense Ministry and the Ukrainian state enterprise "Specialized Foreign Trade Firm" Progress ", which is the daughter of Ukrspetsexport, have signed an agreement for the supply of weapons - BTR-4 and AN-32B, totaling $ 556.5 million, the newspaper reminds.

According to the signed contracts, Ukraine needs to supply Iraq with 420 armored personnel carriers (BTR-4) for $ 457.5 million of them - 270 linear BTR-4, 80 commanders, 30 staff, 30 medical and 10 recovery vehicles. However, the first delivery of the BTR-4 in Iraq has also been disrupted, the newspaper says, and moved to the end of February this year.

The parties also agreed to sell Iraq six transport aircraft AN-32 for $ 99 million

Such a situation could be due to the fact that the government started a massive redistribution of the arms market in Ukraine, writes the "Focus".

"State business on arms exports is now concentrated in the hands of the Regions, the deputy part-Dmitry Salamatina, former head of Ukrspetseksport, and more recently - the head of a newly established Defense Group Ukroboronprom. In November last year Ukrspetsexport tried to take away the" Progress "major Pakistani and Iraqi contracts and dislodge from the transaction intermediary, having good contacts with the Iraqi authorities, "the newspaper said.

According to the publication, available to the Iraqi side has a government guarantee, letter of commitment of the Government of the Ukrainian side, which can be used by Iraq in any international arbitration.

According to the newspaper, 18 January, Prime Minister of Ukraine Mykola Azarov brought to the Cabinet emergency meeting to discuss the fate of contracts, but details of the meeting are still unknown.

some new facts about the ukrainian deal.

Middle men were paid 13% commission ($72M)
Of the order amount, iraq has already paid $11.22M which has vanished.

now at least we know what the "price" of iraqi contracts is.

seems our forum's become quite attractive.

article from yesterday.
A $550 million contract for Kyiv to deliver 420 BTR-4 armored personnel carriers and six An-32 light military transport planes to Iraq, which was concluded in 2009, faces a crisis. Ukrspecexport, the Ukrainian state-controlled arms exporter, hoped that the first BTR-4’s shipped under the contract would participate in the Iraqi Army Day parade on January 5. However, this did not occur. In December 2010, the Iraqi defense ministry had refused to accept both the BTR’s and the first three An-32 aircraft citing shortcomings exposed when Iraqi visitors examined the hardware during a visit to Ukraine. Ukrspecexport blames the company’s former management and hopes the Iraqis will accept the next batch in February.

The contract to deliver the armaments, one of the largest foreign trade deals secured since Ukraine became independent in 1991, was signed in October 2009 by Progress, a subsidiary of Ukrspecexport. Apart from delivering the BTR’s and the aircraft, it provided for rendering services to repair military aircraft. This was planned as only the first in a series of contracts negotiated with Iraq, and Ukrspecexport reportedly hoped the total value of contracts would amount to $2.4 billion to $2.8 billion as the Iraqis were expected to purchase Oplot tanks and additional support services (RIA, December 11, 2009). According to the contract Ukraine should deliver the goods and services within three and a half years. The Kharkiv-based Morozov tank design bureau, the Malyshev tank plant and the Antonov aircraft manufacturer are the main contractors (Interfax-Ukraine, October 28, 2010).

On January 13, the Kiev-based investigative journalist, Mustafa Nayem, reported in his blog on the Ukrainska Pravda website that Iraq refused to accept the first shipment. Interfax cited an informed source that the delivery of the first 26 BTR’s was postponed until late February. Morozov blamed the faults with the BTR’s on gun producers from the Ukrainian town of Kamyanets-Podilsky (Interfax-Ukraine, January 17). Later, Ukrspecexport announced that it would not be fined by Iraq for the failure to supply on schedule the BTR’s and aircraft. Ukrspecexport’s management stated that it had spared no effort to fulfil the contract and blamed the previous management for the failure. Ukrspecexport also accused unnamed journalists of “discrediting” the company’s current management and alleged that a campaign against it had been launched by “circles not interested in the expansion of Ukraine’s international military-technical cooperation” (Defense-Express, January 20).

Ukrspecexport was probably unhappy with a series of reports in Ukrainska Pravda, which suggested that Ukrspecexport’s recent reorganization and a refusal by the current management to pay intermediaries might have influenced Baghdad’s decision. Ukrspecexport’s head, Dmytro Salamatin, said that several subsidiaries of Ukrspecexport would be liquidated in order to streamline its operations, while its website suggested that Progress (which had concluded the original contract with Iraq) was among those subsidiaries. Moreover, several CEO’s were replaced in Progress in 2010. Salamatin complained that Progress did not share important information with Ukrspecexport, and that it had failed to deliver on several old contracts. However, Ukrainska Pravda in the same article depicted several current senior managers of Progress as being unprofessional.

Ukrainska Pravda also cited sources claiming that Ukrspecexport, under Salamatin, refused to pay fees to an unnamed US-based intermediary whose interests in Ukraine are represented by a Ukrainian citizen. The intermediary expected to be paid 13 percent of the contract value. The website cited Salamatin as saying that such intermediaries were “experienced but selfish” (www.pravda.com.ua, January 20).

The Iraqis who checked the hardware scheduled for delivery in December and January reportedly complained that the BTR’ guns were faulty and found that the An-32’s had been assembled from parts made before 2009, while according to the contract the aircraft should be new. In addition, the Iraqis were dissatisfied with the quality of training for their personnel who were sent to Ukraine under the contract. Ukrainska Pravda suggested that it would be physically impossible to replace the faulty and outdated equipment by the end of February as promised to the Iraqis. It quoted Salamatin as saying that if the entire contact is eventually under threat, the former managers of Progress and Ukrspecexport would be blamed as they had failed to comply with Iraqi requirements (www.pravda.com.ua, January 21).

Meanwhile, Ukrspecexport’s former managers may indeed be in trouble, which could further complicate matters with Iraq. The State Financial Inspectorate has reported that Ukrspecexport’s former managers misappropriated the equivalent of more than $100 million in 2008-2010. The inspectorate head, Petro Andreyev, specified that they were suspected of money laundering (RBK-Ukraine, January 19). This may be part of a campaign launched by President Viktor Yanukovych’s team against former top officials who served in the government of Prime Minister, Yulia Tymoshenko, in 2008-2010. Several former ministers have been charged with corruption. The government says this is part of an anti-corruption effort, but the West recently warned Kyiv against using the prosecution against former government officials who are now in opposition (EDM, January 14).

An interesting comment about Iraqi shopping from Ukraina.

Google on-line translate

Guns in the repair

On the failure of Ukrainian military contracts with Iraq

Ukraine failed to fulfill military contracts with Iraq to supply 420 armored personnel carriers and six military transport aircraft, pulling the terms of transfer of the first batches technology. The main reasons are called the redistribution of the Ukrainian market of arms and technical marriage found in armored vehicles. While Ukraine is looking for the guilty and tries to return to the stipulated delivery schedule, Iraq could expose the country to the delay penalties of up to 55.7 million dollars.

No sooner had

Ukraine and Iraq signed two contracts for the supply of armored personnel carriers BTR-4E and military transport aircraft An-32B in late 2009. In particular, Ukraine pledged to turn Iraq over 270 linear BTR-4, 80, command vehicle, 30 staff, 30 medical and ten repair and recovery. The cost of all armored vehicles is 457.5 million dollars. For the six An-32B Iraq must pay another $ 99 million. The total amount of transactions amounted to 556.5 million dollars.

Under the agreement, Iraq was supposed to transfer the Ukraine, 20 percent of the amount in 2009, 40 percent - in 2010, and the same - in 2011. The first AN-32B Baghdad was supposed to get the fall of 2010, but delivery has been postponed. The first 11 BTR-4E were to leave Ukraine in November 2010 in time to take part in the parade, the Iraqi Army on Jan. 5, 2011. Delivery and this party was later moved to the end of February 2011.

What caused the postponement of delivery is still unknown. According to the Ukrainian magazine "Focus" , the disruption of supply of military equipment can be connected from the beginning of the end of 2010 redistribution on the Ukrainian arms market. Control over the export of military production in Ukraine is engaged in state-owned Ukrspetsexport. In late 2010, by decree of President of Ukraine Viktor Yanukovych was formed state corporation Ukroboronprom "which, according to some experts, started the fight with Ukrspetsexport.

According to presidential decree, "Ukroboronprom" will combine state-owned enterprises engaged in the design, manufacture, repair, modernization and disposal of weapons and military equipment, as well as participating in military-technical cooperation with other states. Among these companies: KB Malyshev Kharkov, Kiev and Lviv bronetankoremontnye plants, KB "Ray" and "Progress."

The most interesting is that, under the wing Ukroboronproma "should also be Ukrspetsexport," Ukroboronservis "," Ukrinmash "," Spetstehnoeksport "," Promoboroneksport "and" TASK-export. " In fact, his decree Yanukovych tried to streamline the complex system of Ukrainian market of military exports, bringing together all the companies under a single principle. Despite the fact that before a military exports would meet Ukrspetsexport, his "daughter" could independently engage in foreign deliveries in coordination with the parent company.

According to some Ukrainian experts, the union of different military enterprises in the Ukroboronprome "led to a conflict of interests between the various entities newly-minted state corporation.

However, companies engaged directly the execution of Iraqi contracts, argued that disruptions related to the technical marriage found in the first shipments of military equipment. In particular, Michael Borisyuk, Chief Designer of KB behalf Morozov Design Bureau and head of the Kharkiv Malyshev engaged in the production of the BTR-4, stated that the first armored vehicles have been installed defective 30-millimeter cannon ZTM-1, "misfire and delay."

Defective guns had hastily removed from the APCs and send back to the manufacturer - Plant of Precision Mechanics in Kamenetsky-Podolsk. At the end of January 2011 the gun had to return to Kiev for re-installation on the BTR-4E. According to unofficial information, the party of the An-32B Iraq has not made himself, because the contract was stipulated delivery of new aircraft, and Ukraine transferred to the customer transports, assembled using spare parts, dismantled from decommissioned machines.

Which of the two proposed versions of a true, hard to say. Most likely, they both have a place to be. January 24, 2011, it became known that the Kharkiv Malyshev Plant has announced a massive collection of rare specialties of employees who would be working the Iraqi contract. Plants require more than 400 employees from 42 occupations, including turners, karuselschiki. Not rule out the recruitment of specialists from Russia. Promise to pay at least five or six thousand hryvnia (about 18,5-22,1 thousand).

How the plant will be able to attract the most turners-karuselschikov is unknown. According to the Ukrainian edition of the "Comments" , the workers of this specialty in the Ukraine there are only five or six people, and they earn up to 16 thousand hryvnia (about 60 rubles). A set of new labor force due to the fact that the Malyshev plant just does not have time to prepare their own skilled workers.

Implications

Under the contract with Iraq, the customer is entitled to the supplier penalties equal to one percent of the total transactions per month, starting from the second month of delay. In this case, Baghdad may require no more than ten percent of the total contract value, that is 55.7 million dollars. "Wiggle" Ukraine will be difficult because after the signing of the Ukrainian side has issued a letter of guarantee to Iraq, further strengthens the country's obligations to supply military equipment. This document may be instituted in any court as additional evidence, in addition to the contracts themselves.

January 19, 2011 the Ukrainian media reported that Iraq has put Ukraine penalties of $ 165,000 dollars for the delay in delivery of transporters AN-32B. However, two days later Ukrspetsexport issued a statement saying that media reports about the failure of military contracts are not true. In this case, the statement also said that Iraq refused to penalties against Ukraine agreed by the parties.

"Manual CC" Ukrspetsexport 'making every effort to fulfill contracts with Iraq, which were on the verge of collapse caused by the former company executives. The state company "Ukrspetsexport' also stresses that the current penalties to Ukraine on Iraqi contracts by agreement parties canceled, "- stated in Ukrainian state-owned companies. It is curious that define the line beyond which begins the "failure of the contract, rather difficult. Without official recognition of the failure of contract on the part of Ukraine an arbitrarily long non-fulfillment of obligations can, for example, be interpreted as a delay.

In favor of the version of an internal conflict between the structures of "Ukroboronproma" says the text of the statement. "The former leaders" Ukrspetseksorta "until January 5, 2011 is Dmitry Salamatin, later headed the" Ukroboronprom. Decree of Yanukovych lead Ukrspetsexport was appointed Dmitry Peregudov, head Ukrinmash ", engaged in selling surplus equipment of the armed forces of Ukraine, the disposal of weapons and foreign trade relations. Thus, the blame for the delay was symbolically assigned to Salamatina.

At the very same former head of the Ukrspetsexport opinion. February 2, 2011 Salamatin signed an order dismissing the general designer Mikhail Morozov Design Bureau named Borisyuk. In justifying its decision, Salamatin pointed out that one of the reasons for dismissal was married in the production of the first batch of armored vehicles. Sam Borisyuk announced that his office will not leave - he was appointed Minister of Industrial Policy genkonstruktora contract, and hence Salamatin has no authority to dismiss him.

Whatever it was, but the delay of supply of Ukrainian military equipment - a phenomenon not uncommon. For example, Thailand in 2007, bought from Ukraine 96 BTR-3E1. The deal amounted to four billion baht (130.5 million dollars). The customer for a long time could not get bought armor, because Germany refused to supply to Ukraine, some parts, because of what the manufacturer had to seek new BTR provider. The first armored vehicles arrived in Thailand during September 2010.

Meanwhile, 20 September 2010, Cambodia has received a batch of one hundred Ukrainian tanks and armored personnel carriers. The exact composition of the party is not named, however, indicated that the equipment was delivered on time.

Despite the internal strife in the plans for Ukraine - a further increase in military exports and the geography of supply. In particular, in 2010 the country has shown interest in supplying arms of Brazil. Among the export of military products have been named three-coordinate radar systems, armored personnel carriers BTR-4 and T-84U tanks "Hold." Given the internal quarrels and the imperfection of the production chain and achieve the goals will be difficult.

From new Iraqi Security Forces Order of Battle report.
The first shipment of 26 BTR-4 armored personnel carriers are to be delayed and are now scheduled to be delivered in February. Kharkiv Morozov Machine Building Design Bureau blamed the gun producers from Kamianets-Podilsky. Shortcomings were exposed when Iraqis were examining the APCs. Ukraine tried to deliver An-32s with used engines and avionics. Apparently, they did something similar with the BTR-4s. The BTR-4s were supposed to be delivered in time for the 6 January Army Day Parade. The Ukrainian contract is reported in danger of being canceled.
